• →How a provider decides where you live: Article 5 lists eleven permitted means and allows no more than two of them — an identity document, payment details, the installation address of a set-top box, payment of a public-broadcasting licence fee, an internet or telephone contract, an electoral roll, local taxes, a utility bill, a billing or postal address, your own declaration, and an IP address check.
• →When the IP check stands alone: normally the IP check may only be used alongside one of the stronger means. But if the provider has reasonable doubts during the contract, it may re-verify residence and then use the IP check as its sole means — with the resulting data collected, in the Regulation's words, in binary format only.
• →What portability does not promise: Article 3(3) says the provider owes you no particular delivery quality abroad unless you agreed one, while also forbidding it from deliberately degrading the stream. A portable subscription guarantees access, not the bitrate you get at home.
• →Where it stops: the EU and the wider EEA. The United Kingdom left the EU, so a Sky Sports or NOW subscription does not travel under this Regulation — and a permanent move is not temporary presence, because it changes which country your account belongs to.

Practical rule: inside the EEA, treat a German subscription as a portability question, not a VPN question.The one argument against reaching for a VPN there is written into the Regulation itself: a mid-contract re-verification may use an IP address check as its only evidence of where you live.
